Terms of Use - Renew Photo Enhancement App

Read the Mobile App Terms of Use for the Renew application, available on Apple App Store and Google Play.

These Mobile App Terms of Use ("Terms") apply to your installation, access to, and use of the Renew mobile application (the "App") made available through Apple App Store and Google Play.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

These Terms govern your use of the Renew mobile application distributed through Apple App Store and Google Play. By installing or using the App on your iOS or Android device, you confirm your agreement to these Terms. The App is developed and maintained by Olena Dorohan, who retains the intellectual property rights related to the App, including copyrights, trademarks, design rights, and database rights, unless otherwise stated.

2. License and Restrictions

Subject to your compliance with these Terms, you are granted a personal, non-transferable, non-exclusive, revocable, limited license to download, install, and use the App for personal, non-commercial purposes only. You agree not to: a) copy, modify, distribute, sell, sublicense, or create derivative works based on the App; b) decompile, reverse engineer, disassemble, or attempt to access the source code of the App, except where such restriction is prohibited by law; c) circumvent security features or interfere with the operation of the App; d) use the App for unlawful, abusive, defamatory, infringing, fraudulent, or harmful purposes. Violation of these Terms may result in suspension or termination of your right to use the App.

3. User Content

The App may allow you to upload, import, or process personal content, including photos. You retain ownership of your content. By using the App and submitting content for processing, you grant a limited, non-exclusive, temporary license to process that content solely for the purpose of providing the App's functionality, including photo restoration, enhancement, colorization, scratch removal, lighting correction, or animation features. You are solely responsible for ensuring that: a) you own the content you upload, or you have all necessary rights and permissions to use it; b) your content does not infringe any third-party rights; c) your content does not violate applicable law. Uploaded content is handled as described in the applicable Privacy Policy.

4. App Changes and Availability

We may update, modify, improve, suspend, restrict, or discontinue certain App features at any time without prior notice. The App is provided on an "as is" and "as available" basis. While we aim to provide reliable access and regular improvements, we do not guarantee uninterrupted availability, continuous operation, or the absence of technical issues. We are not liable for service interruptions, temporary unavailability, or feature changes resulting from maintenance, platform restrictions, technical issues, or factors beyond our reasonable control.

5. Subscriptions and Billing

Some App features may require a paid subscription or other in-app purchase. If you purchase a subscription through the Apple App Store or Google Play, you agree that: a) payment will be charged to your Apple ID or Google Play account at confirmation of purchase; b) subscriptions may renew automatically unless cancelled in accordance with the applicable platform rules; c) renewal charges may be applied by the relevant platform before the end of the current billing period; d) subscription management and cancellation are handled through your Apple App Store or Google Play account settings. For subscriptions purchased through Apple App Store, the Apple Standard EULA and related Apple subscription rules may apply where relevant. For subscriptions purchased through Google Play, the applicable Google Play Terms and billing rules apply.

6. Data and Device Security

You are responsible for maintaining the security of your device and any credentials used in connection with the App. You should not jailbreak, root, or otherwise modify your device in a way that compromises security or interferes with the intended operation of the App. You are also responsible for maintaining an active internet connection, where required for App functionality, and for any mobile carrier, data, or third-party charges incurred while using the App.

7. Intellectual Property

All rights, title, and interest in and to the App, including its software, features, user interface, branding, logos, trademarks, design elements, text, graphics, AI tools, and related assets, are owned by or licensed to Olena Dorohan and are protected by applicable intellectual property laws. Except for the limited right to use the App under these Terms, no rights are transferred to you.

8. Third-Party Services

The App may integrate trusted third-party services and infrastructure providers, including services used for analytics, notifications, purchases, hosting, communications, or product performance. These third-party providers may operate under their own terms and privacy policies. While we seek to work with reputable providers, we are not responsible for the independent acts, omissions, or policies of third parties.

9. User Responsibilities

When using the App, you agree to: a) use the App only as intended; b) ensure that your device and operating system are compatible with the App; c) keep your device functional and sufficiently charged for normal App usage; d) avoid unauthorized interference with the App or related systems. We are not responsible for issues caused by poor connectivity, unsupported devices, outdated operating systems, unauthorized device modifications, or third-party interference.

10. Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the App is provided without warranties of any kind, whether express, implied, statutory, or otherwise. We do not guarantee that the App will be uninterrupted, error-free, secure, or suitable for every intended purpose or every image-processing scenario. To the fullest extent permitted by law, Olena Dorohan shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of goodwill, loss of profits, or service interruption arising out of or related to: a) your use of or inability to use the App; b) App downtime or technical malfunction; c) the quality, appearance, or suitability of any processed result; d) unauthorized access to or use of your content or transmissions. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, engage in fraudulent or unlawful conduct, or if suspension is necessary for security, technical, legal, or operational reasons. Upon termination, your right to use the App will immediately cease.

12. Indemnity

You agree to indemnify and hold harmless Olena Dorohan, affiliates, contractors, and partners from and against claims, damages, liabilities, losses, and expenses arising out of: a) your use of the App; b) your uploaded content; c) your violation of these Terms; d) your violation of any law or third-party rights.

13. Feedback

If you submit feedback, ideas, suggestions, or improvement proposals regarding the App, you agree that such feedback may be used without restriction and without any obligation to compensate you.

14. Changes to These Terms

We may update these Terms from time to time. If we do, the updated version will be made available through the App, the relevant app listing, or the associated support website, and the revised Effective Date will be updated above. Your continued use of the App after the updated Terms become effective constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the operator of the App, unless mandatory consumer protection laws of your country of residence apply.
